Caveats

The use of caveats has increased dramatically in past years and at times used inappropriately or simply misunderstood. Stratus Legal have acted for a considerable number of clients to assist them with filing and maintaining a caveat pursuant to an agreement or instituting proceedings for the removal of a caveat.

We confidently advise clients as to their rights and obligations in registering and maintaining a caveat or defending the inappropriate loading of a caveat by application to the relevant Court for orders seeking removal and at times costs.

A little more about our Caveats Services

Each state and territory’s caveat system is different and so the answer changes depending on the state. For example in Victoria, a Caveat never expires until it is dealt with. This may be by a Withdrawal of Caveat, Transfer of Land or other Land Registry Instrument.

Notifications to property owners are sent when a caveat is lodged on your title, this will normally have a copy of the caveat attached which will detail the reason one was lodged. If you are not sure about why a caveat was lodged it is really important you seek legal advice immediately.

The Stratus Legal Group team work along side many dedicated Family Lawyers to ensure the right caveat is lodged to reflect your situation properly. Talk to us today as about whether placing a caveat is needed for your particular circumstances.
